Many companies pressure employees to resign before completing five years to avoid salary increments and gratuity payouts. Further, they use hypocritic tricks to make you  lose  mental health and try to spoil your life. But here’s the truth:

❌ No company can LEGALLY force you to quit!


If you're being pressured to resign, DO NOT SUBMIT YOUR RESIGNATION! Instead, stand firm and take legal action under these protections:

 

✅ Industrial Disputes Act, 1947 (Sections 2A & 25F): Protects against unlawful termination and mandates compensation for employees with 240+ working days.

 

✅ Payment of Gratuity Act, 1972: Employees completing five years are entitled to gratuity. Non-payment is punishable (Section 9).

 

✅ Shops & Establishments Act (State-Specific): Safeguards employees from unfair dismissal.

 

✅ Indian Contract Act, 1872: Any forced resignation that violates your employment contract is legally challengeable.

 

What Should You Do?

✔️ Do NOT resign voluntarily – Insist on a termination letter.

✔️ Document everything – Save emails, messages, and meeting recordings.

✔️ File a complaint – Approach the Labor Department if needed.
